There has been a lot of talk about Amway, but is their news indicative of a pyramid scheme? What is Amway Inc.?

Amway Incorporated is a multi-level marketing company that sells home care products, beauty products, and health products. It was started back in 1959 and has been investigated in many countries globally for its alleged pyramid scheme practices.

Amway Inc. Lawsuits

Amway Incorporated has been at the center of many complaints for the last few decades. A class action lawsuit was filed against the company in 2007. Amway agreed to pay restitution to its consumers for 150 million dollars. The settlement was in response to consumer accusations that they operated an illegal pyramid scheme and at the time this was the biggest settlement in MLM history. Three directors and members of The Advisory board work involved in the class action lawsuit. accusations in the lawsuit stipulated the Amway was an illegal pyramid scheme, that the company focused more on motivation and training products that recruits purchased from them rather than selling products, that the company induces their sales people to buy thousands of dollars worth of products which then means individual workers are already in debt and can only profit if they sell everything they purchased. One of the key accusations was that the arbitration rule in the contract was intended to prevent victim lawsuits which was considered unfair.

Currently the corporation is facing a wave of cases in California. California law has put into effect minimum requirements for how employees and those working for a company are to be compensated and benefited. The state law is making it harder for companies to classify their workers as independent contractors and is expanding the definition of employee. It is doing this in order to protect workers who are classified as independent contractors by companies who want to avoid giving them better pay and benefits. Amway Incorporated refers to anyone who works for the company as independent business owners which means an individual pays fees and then buys merchandise that is sold to others but now they are accused of ripping off those people who sell their products by failing to offer minimum wage.

Why is Amway Inc Considered a Pyramid Scheme?

The trademark of an illegal pyramid scheme and that this company pushes their recruits to focus on recruiting new people rather than selling the products the company has. Other trademarks include requiring workers to buy stock of on moving inventory and requiring them to maintain certain retail sales.

Even though Amway did settle a large class action lawsuit and agreed to pay remedial costs of 150 million dollars, they did not admit any wrongdoing. Unfortunately, 99% of the people who sign up with the company that has been operating has one of the largest and oldest multi-level marketing companies in America, never see a profit.

While it was not deemed a pyramid scheme by the FTC in a 1979 ruling, the FTC did confirm that Amway is guilty of exaggerating income claims and price-fixing.
