Fedloan Serv is improperly reporting 90 days in XX/XX/XXXX late on my credit report for 12 different loans. I received a forbearance on all loans with Fedloan Serv between XX/XX/XXXX and XX/XX/XXXX ( the ” forbearance ” ). As a result, no payments were required during the forbearance period, which is documented by a correspondence from Fedloan Serv and attached hereto. I submitted a dispute with XXXX in XX/XX/XXXX but the dispute was denied in XX/XX/XXXX. I contacted XXXX on XX/XX/XXXX and they told me the reporting is valid and they can not remove the late payment history, despite me offering to provide Fedloan Serv ‘s correspondence approving a forbearance. As a result of the negligent actions of Fedloan Serv and XXXX, my credit score is extremely damaged.

To Whom It May Concern, Thank you for taking the time to review this letter. I am requesting the removal of the disputed 90-day late mark on my credit report from Fed Loans Servicing Agency. I have previously disputed the aforementioned information on the basis of negligence during my account transfer from XXXX XXXX XXXX XXXX to Fed Loans Servicing. As a result of the unfortunate circumstance, the matter was investigated and my account was placed in forbearance during the period the negative mark was reported.

Subsequent to the investigation and the acknowledgment of negligence, Fed Loans approved an administrative forbearance on my account for the months of XXXX through XXXX of 2019 and issued a letter on XX/XX/2019 notifying me the credit information would be corrected and submitted to the consumer reporting agencies. The letter also stated it would take approximately 60 days for updates to reflect on my credit report. However, months has passed since XXXX of 2019 and the disputed 90 day late status is still visible on my credit report for XXXX of 2019. I am respectfully requesting the complete removal of this negative mark on my credit report as I do not want this error to jeopardize my credit worthiness to potential creditors.

Please consider this letter as a formal request to remove the Fed Loans 90 date late negative mark as soon as possible as I do not understand why a 90 day late status remains when my account was in forbearance. Enclosed is a copy of the aforementioned approved forbearance agreement and the credit correction submission.

This matter is being forwarded to your attention for resolution as recommended by XXXX XXXX at the Office of U.S. Senator XXXX XXXX : My XXXX credit report is showing on negative item, my daughter XXXX ‘s student loan which I am a co-signer. Due to unfortunate circumstances, the loan had become past due for a short period. The loan has since been brought up-to-date, with the principle, interest, and late fees now current. According to AES/PHEEA, the loan will be a default status until the loan is paid in entirety, regardless of the fact the loan is up-to-date with no outstanding fees, interest, or principle. I am XXXX years old and XXXX XXXX, and in all my years, I have never heard of a loan being brought up-to-date and still being labeled in default. What is the incentive for anyone to bring their school loan, or otherwise, to a an up-to-date standing by paying all past due fee, interest, and principle if the lender or administrator will not change the default status to current? Any assistance you can provide to have this matter corrected so my credit can be properly reported would be much appreciated.

Full Complaint:
I have over $ XXXX in XXXX school loans currently being serviced by FedLoan Servicing. I am a XXXX and have been making qualifying payments for the last almost 9 years toward the Public Service Loan Forgiveness program. By my own count I have made 105 qualified payments of the 120 payments required for loan forgiveness. FedLoan currently has two of my loan payment counts at 75 and two at 60. These numbers are dramatically lower than the actual count and should be the same as I have never paid on only half of the loans – the payments should have been going to all four. I called and requested a manual recount for my account with FedLoan on XX/XX/2020 but still have not received results of that recount.
