Creditor indicated account deferral was available and – notwithstanding said deferral – subsequently reported account delinquent to the credit reporting agencies ruining an otherwise perfect credit history. Creditor should investigate and correct account history consistent with protections available for those negatively impacted by COVID-19.

Ally Financial has reported a ” remark ” and incorrectly reported a balance increase, for my auto loan, which was completely unwarranted, as I have NEVER been late on a payment since the loan was taken out almost 2 years ago. This has caused my credit score to drop tremendously. I have called several times and have been given reference numbers, but that’s about it. My credit score is not where it should be because of these obvious errors.

I was billed by both parties. Ally bank sent bill {00.00} deductible of totaled car from riots in XXXX XXXX. XXXX XXXX already charged me the {00.00} and Then XXXX paid Alley more money which made the {00.00} to {00.00} .and then another {0.00}. I have documents to back it up as well as letters from the Department of Insurance of seeing XXXX wrong doing. But I continued to pay for car even when is was totaled XX/XX/XXXX. XXXX sent Ally a check for car that was wrong amount because XXXX didnt compare like cars during assessment. I have proof. Then ally reported me to collections immediately for no reason. I dont owe Ally for my deductible since it was paid to XXXX. The car was vandalized. And took XXXX 4 months to take care of. Not my fault XXXX and Ally have horrible communication skills and Ally didnt investigate the {00.00} difference in. Comparing the same cars. ( how XXXX estimates the value of totaled vehicle ). And Ally has no right to report me without sending proper bill within 30 days.

Last year in XXXX of 2019 I was fired from my employer, In good faith he offer to take responsibility since I couldn’t afford to make payments on the car anymore. I have text messages proving that he ask me to call the bank for the payoff, but he change his mind I also have text messages proving that I ask him for the keys so I can call Ally Bank and turn in the car. In XXXX he text me and told me the car is in the shop but he never told me what shop the car is at??? I call and write to Ally Bank explaining the situation and mail screen shots of the texts but Ally Bank never reply regarding about what my former employer has done but they are reporting every month for miss payments. When Ally Bank is fully aware that someone else has kept the car hidden from me! I only receive one letter from Ally Bank claiming that they can’t comment on what my former employer has done and the dispute is only between me and Ally Bank. But according to the Federal Rules of Civil Procedure there are rules that include an 3rd party or an non party.

Rule 14. Third-Party Practice ( a ) WHEN A DEFENDING PARTY MAY BRING IN A THIRD PARTY. ( 1 ) Timing of the Summons and Complaint. A defending party may, as third-party plaintiff, serve a summons and complaint on a nonparty who is or may be liable to it for all or part of the claim against it.

( 3 ) Plaintiffs Claims Against a Third-Party Defendant. The plaintiff may assert against the third-party defendant any claim arising out of the transaction or occurrence that is the subject matter of the plaintiffs claim against the third-party plaintiff. The third-party defendant must then assert any defense under Rule 12 and any counterclaim under Rule 13 ( a ), and may assert any counterclaim under Rule 13 ( b ) or any cross claim under Rule 13 ( g ). ( 4 ) Motion to Strike, Sever, or Try Separately. Any party may move to strike the third-party claim, to sever it, or to try it separately.

Rule 22. Interpleader ( 2 ) By a Defendant. A defendant exposed to similar liability may seek interpleader through a cross claim or counterclaim.

Rule 71. Enforcing Relief For or Against a Non party When an order grants relief for a non party or may be enforced against a non party, the procedure for enforcing the order is the same as for a party.

I written to Ally Bank regarding to theses Federal Rules of Civil Procedure Rules and Ally Bank has never reply?!
