I do not recognize this inquiry, and have submitted over and over for proof that I indeed consented to this inquiry. Not once, has anyone taken into consideration what I am saying and have verified indeed that this is wrongfully reported onto my consumer report. I would like to be provided proof I consented to this inquiry via FCRA section 609 and 605 as well as the accuracy of this inquiry via FCRA section 623. If you have no irrefutable evidence, proof that I in fact was the one seeking to obtain a line of credit and the creditor had a permissible purpose to in fact and legally obtain my credit file information after a positive identity verification, immediately of any or one, I would like it removed immediately.

Full Complaint:
We have a GM Card serviced by Capital One. Our last payment due date was XX/XX/XXXX. We set up a payment in full on our XXXX XXXX bill pay for XX/XX/XXXX, and according to bill pay, the payment was mailed in time to be received XX/XX/XXXX. We noticed that the payment had not been taken from our checking account as of the XX/XX/XXXX, logged in to Capital One on XX/XX/XXXX, and saw that a late fee had been charged. We called Capital One on XX/XX/XXXX, and they told us they had not received our payment. We talked to a supervisor, and she suggested that we should make sure our payment is received 5 to 7 days before the due date. That was her only advice. She did reverse the late fee. On XX/XX/XXXX, we received an email from Capital One that they still had not received our payment. As of XX/XX/XXXX, they have charged interest on the account balance. We called XXXX XXXX, which is our checking account, the evening of XX/XX/XXXX, and they asked us if the address had changed. We looked at our statement, and sure enough, the address had changed. XXXX XXXX put a stop payment on the check, and we went on XXXX XXXXs website to make the payment. It processed on XX/XX/XXXX. There is no notice anywhere on the statement to make it obvious that the address is different, and since we use bill pay, we didnt notice the change. We have had a GM Card for almost 30 years, and this is the first time in all that time that the address has changed, and I would call that a big deal. So our complaint is that, 1 ) there should have been a big notice on the bill that the address is different, and 2 ) when we called Capital One, that should have been the first thing they said, hey, weve got a new address.
We had a similar issue with them last XX/XX/XXXX. Two months in a row, we called Capital One because they had not processed our payment on time and slapped us with a late fee. They had issued us new cards because of fraudulent activity, and we forgot to update our account number in bill pay. They could have nicely said, hey, update your credit card number in bill pay, but they didnt. It wasnt until we filed a complaint with you, and they filed their response, that we saw our mistake. I dont think they would have ever said anything to us about what was causing the problem if we hadnt filed the complaint.
They dont try to help solve the problem. We cant help but feel that they dont want to point out our errors, so they can collect late fees and interest on their customers.
We have credit cards with several companies, and this is the only company that we have ever had issues with. And I would also add that until Capital One took over the GM Card, we never had a problem with this card either.

I owe just a little over 2000 to capital one. I was making payments and the amount just kept going up drastically. I had to let it go default and charge off because I could n’t pay thousands for only spending around 1500. I then made a agreement for around 1300 with capital one and they never withdrew my money even after attempting to make payments. They are now sueing me in XXXX county georgia where I live. I only found out of this by letters from lots of differant lawyers trying to get me to file bankruptcy. I spoke with capital one hired lawyers it ‘s called winters and something. I made a arrangement to pay with them. I told them I would pay XXXX right now and that was last week. They were very nice to me on the phone and said they would have a letters at my house this past Monday for me to sign showing the judge I did have intent to care for this matter. I have yet to receive any letter or have any funds taken from my account. I did give them my account and routing number to make the payment. I have tried everything I possibly could have to care for this situation and I feel like I am being taken advantage of. I did tell them I was a veteran and right away everything changed with the lawyers same with capital one. I just want to be able to pay what I owe and not end up in jail over a debt. XXXX XXXX 2015 I was evicted from my apartment. All my personal belongings including identification we ‘re padlock inside and later thrown out. When checking my yearly free credit report there were fraudulent accounts in my name. When contacting the credit companies some did n’t hesitate to close and remove the accounts from my credit. Kohl’s/Capital One agent could n’t careless and used the number I called to harass me for payments. The other two accounts were with XXXX/XXXX and XXXX XXXX XXXX which has now sold the account to XXXX XXXX. XXXX and XXXX has removed the fraudulent accounts but XXXX continues to report the fraud accounts even after multiple dispute submitted to XXXX.
