Full Complaint:
In order to have a credit card from Capital One I made a security deposit of {.00}. On end of XX/XX/2019 I closed the account and according to Capital One I would receive my security deposit after 2 billing circles. So on begining of XXXX I was wondering where was my check and I called them on XX/XX/XXXX saying that I hadn’t received the check and also I mentioned that I had move to a new address. They told me they would send a new check to my new address. On XX/XX/XXXX I contacted them again and I said that I hadn’t received the check. They said they would issue a new check because the last one returned to them. I confirmed the new address with them and they had it right. I made a new contact on XX/XX/XXXX and I informed again that I hadn’t received the check so they told me they would make a deposit direct to my banking account in untill 7 days. On XX/XX/XXXX I called them and I said I hadn’t received any deposit on my banking account. They did not explain why the deposit wasn’t made and they told me to wait more 10 days. I told them that I was tired of this and I would go after my rights in order to have money back. I made a complaint to Department of Banking and they returned on XX/XX/XXXX saying that forwarded my complaint to CFPB.

I contacted Capital One Credit Card on XX/XX/XXXX as a preventative measure as I had fraud on another credit card this past month. I wanted to add an additional security question to my account. During the conversation with the agent, I found out inadvertantly that Capitol One had given access to an additional person in XXXX that I never gave permission to as this was an individual account.

I told them to remove the name immediately. I called in later that evening to ask for additional information on how this situation originated. I wanted to know how the permission was given, what relationship was provided, contact info, etc. and when exactly in XXXX as this was a direct violation of my privacy and Capitol One was negligent.

I knew they had this info documented and recorded but they told me it had been erased from their system. A fraud supervisor named XXXX told me to call on XX/XX/XXXX which I promptly did the next day. The woman I talked to XX/XX/XXXX indicated that she did not have the information on her screen but stated that if I reported it to the local PD and had a case file that I would be able to obtain the information which seemed absurd but I did contact our PD XX/XX/XXXX. When I called them again XX/XX/XXXX, they said I would need a subpeona which is ludicrous. The Capitol One woman was adamant. I believe it is because they made a mistake and they know it.

I have a right to this information. It’s my cc account and my privacy that has been completely violated for 8 years.

XX/XX/19 Card was given to car rental company XXXX XXXX as to repair one scratch caused by me.
XX/XX/19 Charge was made to a merchant whom I dont recognize for {0.00} Later XXXX XXXX sends me the receipt for the repair charging {0.00} to repaint bumper AND fender AND reform bumper XX/XX/19 Filed a fraud charge and temporary credit was given XX/XX/19 Charge was reapplied because I gave consent. I did to fix ONE scratch and nothing else. They went and repaired all the damage on the car made by other people too. Case transferred to dispute team.
XX/XX/19 Dispute team grants temporary credit. I promptly submit a document explaining the story.
XX/XX/19 Receive a letter saying investigation was not in my favor and credit will be reapplied. I state that its fraud. You cant have person A give merchant B a card and then merchant B uses at merchant C.

XX/XX/XXXX Capital One closed my credit card stating they received documentation from the credit reporting agency that the account was opened fraudulently. This account was opened in XX/XX/XXXX and I’ve never had not one problem regarding fraud/cap one until now. The fraud case was closed and now capital one has added a new card number and late payment history when I had no control over the process. The noble thing to do was to inform that the case was closed and payments will resume as scheduled but I never had access to my account while this was taking place. Fast forward to today and I am in the process of buying a home and the late payments are ruining my chances of getting this home for me and my family. I called each credit bureau and they removed the late payments until a few days ago they were added back. Please assist me regarding this matter is this even legal for to be treated/handled like this?
