I received an letter which was also uploaded into this cfpb system stating that my accounts were eligible for SCRA benefits and we enrolled. I called to pay off the remainder of the debts to be determined following a recalculation of the new amount due only to find that Capital One only applied SCRA benefits on the account ending in XXXX. The account ending in XXXX was not recalculated and the file was documented as ” no adjustments to be made to account. ” I am a Ohio resident and SCRA applies to all debt prior and during military service. The interest rate for this account should have been capped at 6 %.

According to Capital One Auto, a consumer credit transaction application/contract was manufactured by XXXX and furnished to me XX/XX/XXXX for a XXXX red XXXX XXXX for the alleged amount of the total sale price {000.00}. The Finance Charge of {000.00} and the amount financed {000.00} with a total of payments, {000.00} with a {0.00} down payment. The contract also stated and identified me the consumer with full security interest. ACCOUNT # XXXX I received several monthly statement requesting payment of account with the alleged debts and it’s due balance which I offered to perform in good faith to settle upon the condition that Capital One Auto provide me all the necessary proof of evidence pursuant the ” Fair Debt Collection Practices Act ” [ 15 USC 1692 et seq. ], which I listed in requests documents numbered below. Also I have discovered in the contract provided that TITLE 15 U.S. Code 1601 TRUTH IN LENDING ACT WAS NOT EXERCISED NOR DISCLOSED NO WHERE IN THE SAID CONTRACT WHICH CONSTITUTES A DEFAULT. After viewing other sections of the contract I also discovered there was no mention or disclosure of GAAP with the said contract.

1. Debt Collector Disclosure which they did not provide with their letter of response.
2. Affidavit Of Debt Validation which they did not provide with their letter of response.
3. To Cease And Desist which they ignored. Pursuant the Fair Debt Collection Practices Act, 15USC 1692c ( c ) 4. Requesting full disclosure of GAAP.
I have given Capital One Auto multiple default and opportunity cure the issue at hand by sending all my affidavits certified mail and they have yet to respond to me with the requested information.

Hello, I am writing to contest a massive downgrading of my credit score. In XX/XX/2021, was offered a Capital One Cabela ‘s club during my time of purchase at a Cabela ‘s store. I took the offer, gave Cabela ‘s my contact info, and paid for my goods totalling {0.00}. Long story short, I did not receive any notices or bills at my house for three months, until at which point I realized my credit score had sufferred a huge downgrade from XXXX to XXXX. I immediately called Capital One after talking to my mortgage broker and explanied to them the situation. I paid the card balance in full and then closed by account.

It simply does not make any sense that out of the $ XXXX I spend on credit each year, and that I also pay down each card very quickly, that a {0.00} late payment should crush my credit score. Capital one asked me to verify my deposit now they are asking for more documents than my loan originator asked for this is unfair and invasive and a witch hunt that was triggered by a call from an ex girlfriend to them and she even told me they discussed specific information about my account with her which is against the rules. I intend to seek legal representation. I will gladly provide the cfpb with documentation verifying the deposit belongs to me. I will also provide a statement showing the disbursements with the last 4 of my capital one account showing. The Sba even approved my loan forgiveness application sba # XXXX and sba # XXXX ( screenshots below with loan numbers and my email address ) so therefore capital one is unlawfully holding my funds. I contacted the i team as well. Furthermore my account reflects legitimate use for ppp funds which is rent for a part of my business- not that I have to explain that to my bank because it has already been explained to lender and sba and approveed which is reflected below in attachment.

I have talked to Capital One three times. Each time I've been told that the problem is resolved and I should be getting a credit for {0.00} for a return that they didn't apply correctly. They actually made the credit in XXXX or XXXX of this year and I thought that settled the matter. THen in XXXX, I get the amount debited to my account out of the blue. I call Capital One and they assure me it's an error and they're fixing it as we speak. Today I get another bill for the same amount.

I'm at the end of my rope with these incompetents. I want to cancel the account but I can't as long as there is a balance due. I should have a XXXX balance.
