On XXXX XXXX I made a partial payment of {00.00} towards a vacation package to XXXX, Mexico for dates May XXXX XXXX XXXX via XXXX on my capitol one credit card. I made a second payment on XXXX {00.00} for a total sum of {00.00}. On XX/XX/2020 XXXX stop it services with no notification to their customers and they provided no refund. They deactivated their website and close all their call centers leaving no possible way to get in contact with them. The flights for the vacation package was book through XXXX via XXXX. XXXX refunded two flights ( Ticket Number/Amount/Form of Payment XXXX $ XXXX ) ( Ticket Number/Amount/Form of Payment XXXX $ XXXX Check # 2 ) on two separate dates in the form of a check. The first check was sent to XXXX on XX/XX/2020 and the second check was sent on XXXX XXXX but no money was returned to my credit card. After contacting XXXX I was informed that both checks were sent to XXXX and both checks were cashed. I then proceeded to contact Capital One of to dispute the charge due to the service not being render by XXXX. After provided them with all this information and documentation, Capitol One decided to decline my dispute.

I disputed a late payment on my Credit report as inaccurate for my Kohls Charge # XXXX card a 30 day late for XX/XX/XXXX and a 60 day late for XX/XX/XXXX. And as how could this be factual when the montths XXXX- XXXX and XXXXand XXXX shows ok. XXXX results were that they verified this as accurate, I spoke to Kohls as well 0n XX/XX/XXXX and they said that their system only goes back that far for payment history so how did XXXX verufy this information when. The creditor Kohls cant even see it in their own system.

I entered a consumer credit transaction on XX/XX/2020 with Capital One and for the application it asked for my social security card which under 15 USC 1605 ( l ) The term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. Any meaning no restrictions, that would mean my social security card which was used in this consumer credit transaction. Since this is commerce and the United States is a corporation under 28 USC 3003 and anything purchased using my social security card is Obligation or other security is of the United States under 18 USC 8. It’s ambiguous to deceive a consumer into owing an alleged debt, when it was paid for at the start of the transaction, Capital One is just a extension of my Credit extended back to me. Capital One is furnishing deceptive forms, statements, and contracts that comes in a positive balance each month. XXXX positive balance and XXXX negative balance, it’s impossible to pay on a positive balance because Capital One was paid at the start of the consumer credit transaction. They need to be held accountable for their actions in this corporation.

Full Complaint:
Approximately in XXXX of XXXX I personally reached out to Capital One via their telephone customer service to explain mitigating circumstances surrounding a late payment they reported in XXXX of XXXX. I explained to the representative that the only reason why I was late for said payment was due to a combination of being in an already difficult financial situation ; as I had just separated from the United States Army after serving for 6 years, and being laid off from my newly acquired civilian job as a result of the Corona Virus pandemic. I was told the representative wasn’t able to personally do anything about the situation, but was encouraged to write a letter and physically mail it to Capital One ‘s credit reporting department. Within the same month of XXXX I decided to do just that, and even more thoroughly explained the situation in said letter. Initially I had high hopes that Capital One would recognize the fact that even the federal government has acknowledged the tremendous negative economic impact the Corona Virus has had on our country, which has resulted in the government pouring trillions of dollars in various legislation in an attempt to bring to the country ‘s economic state around. However, what I later received was anything but understanding or the reasonable use of discretion by Capital One. They mailed me a letter that appeared to be one of likely thousand of templates used to handle customer complaints, that simply stated essentially that they were ‘unable to do anything ‘. I genuinely believe that a reasonable person would agree that Capital One is acting unreasonably in regard to my situation.
