15 USC 6809 ( 9 ) ( 9 ) Consumer The term consumer means an individual who obtains, from a financial institution, financial products or services which are to be used primarily for personal, family, or household purposes, and also means the legal representative of such an individual.

You are a financial institution according to 15 USC 6809 ( 3 ) ( a ) ( 3 ) Financial institution ( A ) In general The term financial institution means any institution the business of which is engaging in financial activities as described in section 1843 ( k ) of title 12.

You as a consumer 15 USC 6809 ( 9 ) I am the natural person, and agent of the consumer XXXX XXXX XXXX XXXX who obtained from you CAPITAL ONE a credit extension, a service that created an account and I want said account to be sent to the original Creditor, I want the funds from this account to be reimbursed to the original creditor of this account.


Any digital contract that has been created with this Credit Extension and the issue of the account, card number : XXXX that rests in you is rescinded and it is required that the funds be remitted to the original creditor. As the original creditor I demand that all funds that resulted in the issuance of this account be refunded to me within 20 days. Otherwise I will be forced to file a lawsuit. I have all the relevant evidence to show that you used my credit without my consent. This complaint is in regards to Capital One Credit Card company, XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX. On XX/XX/2021, I applied for a credit limit increase for my Walmart card ending in XXXX. On XX/XX/2021, I recieved a letter from Capital One denying the increase due to they could not resolve the consumer alert on my credit file. There are two problems with this, first the second call was placed by Capital One, on XX/XX/2021 at XXXX, which is illegal. I did answer the call, which the call did not connect, also whenever Capital One would call about this, they would leave no message. My first complaint is that the credit card company should NOT be contacting a customer at that time of morning, i believe that is in violation of a federal law. Second, I spoke to XXXX, id XXXX on XX/XX/2021, i have never met such a rude and incompetent person who works on a customer service line, she offered no help, gave me attitude, and basically said well if the request is denied, its denied. A request for an appeal to the decision was asked, but ignored and she refused, probably because she is way more than incompetent. Also, XXXX lied to a customer, she told me that the supervisor i was speaking with, XXXX id XXXX was her direct supervisor, which was not correct, XXXX reports to another manager. XXXX was very lax in filing a complaint about XXXX, must be friends, and also much like her friend XXXX did nothing to address the situation or help the customer.
