capital one stated they closed my account on XX/XX/2021 due to a returned payment that was in default from a XX/XX/2021 payment. I called in XX/XX/2021 to try to see what happened to that payment and another payment that I tried to pay the balance in full for XXXX dollars. The representative told me as long as I make some kind of payment then my account would be okay which I did for XXXX dollars. The very next day they closed my account. When I explained their system made an error in trying to pull the money from my old bank account the first time, which was verified then they lied and stated that is was closed due to a second payment that was returned from another bank account. When I asked to verify what bank account number they had so I can make sure it was my error in entering in the information they proceeded to tell me that they could not provide that information nor reach out to my bank to verify any account. Even though I was able to pay the account in full they said they reserve the right to keep my accounts closed even though I have been a loyal customer and have made every attempt to rectify the situation.

I got a phone call from a Mr. XXXX, he left as voice message stating he worked for an attorney named XXXX XXXX. He was making a final attempt to deliver a summons for court. He tried my home and my work and could not locate me. If I needed any further details, please contact this legal firm. If I did not contact them, it would result in further legal action without my knowledge or consent. I have been served.

I then called and spoke to Mr. XXXX and told him that I don’t have a place of employment, and that I was on Social Security. I also told him that I don’t recognize that debt. It was from an Orchard Bank, for a XXXX Visa card, in the amount of {00.00} He told me that they would take me to court and I would pay all fees therein, which would amount to approximately {00.00}.
I asked him what was charged on the card and he said he couldn’t tell me that information, but I could ask the judge for them to reveal that, but it would cost me another {00.00} because we would both have to show up in court again.

I advised him again that I was on Social Security and could not afford this debt that I wasn’t even sure was mine. He had all my personal information. He stated the debt was from XX/XX/XXXX to XX/XX/XXXX, This is 12 years ago, and this is the first I have heard of it? I told him that I was afraid that this might be a scam. He said it was not and gave me the attorney name of XXXX XXXX.

He also said that he could put me on hardship program of $ XXXX/month, and that would come out automatically every month. He said he would talk to the attorney, and make sure this was a good offer and he would get back to me today. He called and left a message today that the attorney would give me two options and to call him and we would get this going. He emailed me a Docu-sign that I was supposed to sign and email back, it had two offers on it, but I was afraid to open it, so I didn’t.

On XX/XX/XXXX, I saw an ad for a set of wheels for a car on XXXX account XXXX XXXX XXXX. Contacted the account owner through XXXX messages and asked for the price of the wheels plus shipping. Was given a price of {0.00}, {0.00} for wheel plus {0.00} shipping. Sent {0.00} thru XXXX from my Capital One Checking account to XXXX XXXX thru his email contact XXXX. On XX/XX/XXXX, Seller sent message stating that was getting ready to ship the wheels, but then requested another {0.00} for shipping insurance. Told seller that I paid the price I was told for shipping, which was {0.00}. Asked for a refund and seller stated they did not give refunds. Only gave refund for items that did not meet the buyers needs. I tried to request money back through XXXX, I got a message that there was a problem with the recipient ‘s zelle account. Also the XX/XX/XXXX page post have been removed.

Capital one Bank approve me for an unsecured credit card and want me to pay in advance {0.00} dollars. I paid {0.00} dollars and received the card by mail. After two years I closed the account with XXXX balances. The bank sent me a bill of {0.00} dollars to pay again. I dispute the wrong charge of {0.00} but Capital one bank reported to the consumer reporting agencies and destroys my credit history. I am still reporting or disputing this wrong charge to consumer reporting agencies.
Banks don’t approve unsecured credit cards unless the consumers pay in advance the approved amount.

XXXX I received a XXXX XXXX XXXX from Capital One for {0.00} with an aggressive interest rate. I paid that amount back but Capital One continued to move forward with late fees and such despite my telling them that I paid the {0.00} back and was now suffering from a brain injury. It was charged off in XXXX, per a phone call I took today from the Capital One Appeals team.

Now, in XXXX, I was served papers for a suit where Capital One is claiming I had a credit line of $ XXXX. This was on the repair side of a bankruptcy and, no, I never had a credit card from Capital One for XXXX. I suspect, they compounded late fees and interest to craft an amount that would be worthy of investing in court fees and legal counsel. I am convinced this is a needlessly aggressive amount and the lawsuit for the incorrect amount is simply compounded interest made for the convenience of Capital One and in hopes I would be easily bullied due to my brain injury.

I am not. Instead of ” rolling over ” I filed an Answer to the XXXX County Circuit Court — explaining the above — and also spoke to the XXXX XXXX handling the debt collection.

I only ever received a credit card for {0.00} on the recovery end of a bankruptcy case. I paid that back but the answer I sent to the court would be to pay the {0.00} again despite being unemployed and supported due to COVID-19 recovery efforts.

Meanwhile, I’m suddenly now ( in XXXX ) getting calls and letters from Capital One for the wrong amount owed now in despite the five years of silence between the ” charge off ” since XXXX.

There is something very wrong here.
( I NEVER had a card from them for $ XXXX! )

IVE CONTACTED CAPITAL ONE BANK INXX/XX/XXXX AND SEVERAL TIMES AFTER ABOUT A FRAUD APPLICATION THAT WAS PROCESSED BACK IN XX/XX/XXXXTHEY VE TOLD ME THAT THE APPLICATION WAS CLOSED AND THE INQUIRY WAS PROCESSED FOR REMOVAL FROM XXXX AND XXXX WITHIN 90 DAYS APON CHECKING ITS STILL SHOWING ON BOTH CREDIT REPORTS EVEN AFTER SENDING ME DOCUMENTATION THAT IT WAS FRAUD. THIS IS AFFECTING MY CREDIT AND CAPITAL ONE ISN’T DOING ANYTHING TO REMOVE IT.
