The creditor/ " debt collector '' has failed to adhere to Section 809 ( a ) ( 1-3 ) within the Fair Debt Protection Act, stating that within five days of initial communication the creditor/ " debt collector '' is required to send the consumer written notice containing : -The amount of the debt, -The name of the creditor to whom the debt is owed, -A statement that unless the consumer, within 30 days after receipt of notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector.
I have since made them aware of their violation and have proceeded to ask them to validate the account as outlined within Section 609 of the Fair Credit Reporting Act. With failure to send back proof including a signed application within 30 days of request, the creditor/ " debt collector '' has violated my rights and is required to remove the alleged debt.
