Hello, I opened an account with Discover Bank and a bonus offer code of XXXX. Through this bonus if Discover Bank received an ACH deposit to my account for over XXXX dollars per month I would be eligible for a XXXX dollar bonus. I met these requirements as of XXXX 2015. Their fine print states that the bonus will be deposited within 30 days of fulfilling the deposit requirement. I opened my account XXXX XXXX 2015.

I have spoken to Discover Bank on two different occasions now and they have not been clear about depositing the bonus owed to me.

Discover card is reporting that I have a joint account with my husband. The account was opened before I even knew him. It was opened XX/XX/XXXX. We did not get married until XX/XX/XXXX. He added me as a user on the card. They had none of this information on me when I called they did n’t have my dob XXXX/XXXX/XXXX my ssn XXXX and my marriage date of XXXX/XXXX/XXXX. This is preventing us from getting a rental which is larger than what we have. I have not filled out any application and they did not have the above stated items. I would like the reported part removed from my correct report and the judgement removed from my credit report.

The Discover credit card has been charging us cash advance APR of 24.24 % at a variable rate for years now and it is more than the minmum payment. We have not used the card for years and ca n’t seem to pay it off because of this issue. I spoke to their management and was told if we pay more, than amount would go to minmum payment not the balance which would keep us in the vicious circle of the interest rate taking all of the payments. Can you help us …? we are willing to pay more but want the balance to show signs of going down and the APR to go back to regular APR 13.49 %. Again we have not made any cash advances on this card for years. We have been with them since 1987.

I have had a Discover card since 1983. I have had to use this card in the past three years for various purchases. I noticed that even making my payments on time and paying just over the minimum, my balance did not seem to go down! At one point I had done a balance transfer to this card only to find out that one month my interest charge was more than my payment!! I cut up my card and sent it back to them. After several attempts to try and get my interest lowered, they wo n’t even budge. Now, after making my payment, less than {.00} goes to the principal and my minimum payment keeps increasing!!!! I am never going to get this paid and it now has caused me financial issues.

In XXXX XXXX a Discover credit card was opened in my name and reported on my credit report. ( Acc # : XXXX ) XX/XX/XXXX was the date of last payment and the end of all activity on the account. As of XXXX XXXX, the account was listed as ” closed/charge off ”.

XX/XX/XXXX this item was removed off of my credit report because it was past the XXXX XXXX year threshold for reporting bad debts.

XX/XX/XXXX I received notice from the Federal IRS that a XXXX form was submitted to them XX/XX/XXXX for the above listed debt- nine years after the date of last activity.

The rules of issuing a XXXX form are clear. XXXX forms are to be filed NO MORE than after a 36 month nonpayment testing period expires. That non-payment testing period ended XX/XX/XXXX, and furthermore was past the statute of limitations ( For Wisconsin, where the debt was supposedly incurred ) in XXXX XXXX.

I formally request that Discover Financial Services notify the Federal IRS that the XXXX form was issued in error and is to be withdrawn.



Furthermore, in XX/XX/XXXX I attempted to contact Discover Financial Services about the inappropriately filed XXXX form and was transferred to an active collections department without my knowledge. In the state of North Carolina, which is where I reside the law is clear, and Discover Financial Services was in violation of : North Carolina Fair Debt Collection Practices Act XXXX XXXX XXXX. Deceptive representation.

Failing to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector It appears that what has happened here, is that Discover Financial Services has purposely issued an incorrect XXXX form with the intent to coerce payment through unconscionable means on a debt that is well beyond the statute of limitations. This also is in violation of : North Carolina Fair Debt Collection Practices Act 58 70 115. Unconscionable means.


1 ) Seeking or obtaining any written statement or acknowledgment in any form containing an affirmation of any debt by a consumer who has been declared bankrupt, an acknowledgment of any debt barred by the statute of limitations, or a waiver of any legal rights of the debtor without disclosing the nature and consequences of such affirmation or waiver and the fact that the consumer is not legally obligated to make such affirmation or waiver.
