Ive been in contact with DISCOVER on multiple occasions in regards to this matter.

They have violated my rights under the FCRA, FDCPA, The Privacy Act Of 1974. XXXX has disclosed my private information including my phone number, address, name and social security number to credit reporting agencies and other third party vendors.

The Privacy Act Of 1974 The Privacy Act prohibits the disclosure of a record about an individual from a system of records absent the written consent of the individual, unless the disclosure is pursuant to one of twelve statutory exceptions.

DISCOVER violated this act they had no permission by me the consumer to disclose any of my private information.

They also violated my rights under the following statutes.

15 USC 1692b Acquisition Of Location Information. – Shall not state a consumer owes any debt.

In which reported on my consumer report that I owe the a debt. In which the debt has already been paid in full.

15 USC 1681b Permissible Purpose Of Consumer Reports ( 2 ) In accordance with the written instructions of the consumer to who it relates.

I never gave DISCOVER any written consent to disclose any information on my consumer report.

15 USC 6802 Obligation With Respect To Disclosures Of Personal Information A financial institution my not directly or through any affiliate disclose to a nonaffiliated third party no public personal information unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title.

DISCOVER did not provide me with any notice about disclosure of my personal information to any non affiliated third party. That includes credit reporting agencies or any other data recording agencies.

Full Complaint:
In Mid XX/XX/2021 I applied for a secured credit card with Discover Financial Services. They approved me for a secured credit card, and I sent them my {0.00} deposit for the secured credit card. Once they received my money, Discover Financial Services sent me via email a XXXX tax document to sign. I refused to sign this document because as I stated this was a secured card and I have had them in the past with other financial institutions without having to sign a XXXX tax document. They also would not provide a rational explanation for requesting this document other than for identity purposes.

Therefore I was forced to close an account that was never actually approved because I refused to sign the XXXX, also they ask for this after they got my {0.00} deposit. This is an important issue the deserved to be disclosed upfront in the application process. Finally I do NOT want my credit scored impacted because I had to closed account that was never actually opened from my perspective, reported to the credit bureau. But from Discover ‘s perspective they said I would have to close the account. I want my deposit refunded asap, as well as DFS NOT reporting this to any of the 3 credit bureaus.
