Full Complaint:
See Experian Complaint # XXXX / Filed XXXX/XXXX/XXXX. Experian responded on Friday, XXXX XXXX, XXXX claiming that the ” address I supplied does NOT match any previous address on file. However, the CFPB is not letting me make a follow-up reponse ( AS ALLOWED ) on Monday, XXXX XXXX, XXXX. Thus, I am having to file a new complaint in order to dispute Experian ‘s XXXX XXXX, XXXX response to my ” original ” file date of XXXX XXXX. XXXX, as follows : There is no federal statute under the Fair Credit Reporting Act that requires me to provide ” proof of address. ” This may be a Experian ” policy ” requirement but it is NOT a ” statute ” requirement under the Fair Credit Reporting Act. The ONLY ” statute ” requirement is ” proof of identity ” and not ” proof of address. ” I refer you to the Fair Credit Reporting Act under Section 611 [ Procedure in Case of Disputed Accuracy ], which follows Section 610 ( a ) ( XXXX ) [ Proper Identification ], which states that ” a consumer reporting agency shall require as a condition of making the disclosers required under Section 609 that the consumer furnish proper identification. ” Verification of ” identity ” is provided under Section 609 ( e ) ( 2 ), which says that ” before a business entity [ Experian ] provides any information … as proof of positive identification … the presentation of a government issued identification card. ” I provided Experian a copy of a government identification, specifically, my passport and I provided my current mailing address in my ” original ” credit report dispute. Importantly, Experian is claiming that my address does not match the address on file. I can not help it if their computers do not have my current address on file, especially since I have not had any activity ( applied for credit, etc. ) within the last 7 1/2 years. They have my current address because I have since received their XXXX XXXX, XXXX letter requesting ” proof of address ” at the SAME written address that I provided in my ” original ” credit report dispute. See attachment filed with this response.
Further, I provided a XXXX ( XXXX ) page detail that was highly specific with account information that overwhelmingly gave Experian a ” high degree of confidence. ” Not only did I list the ” original ” creditor name and ALL account numbers but I also listed ALL the collection agencies ( assigned collection to the ” original ” account ) names and their account numbers for the XXXX ( XXXX ) accounts that I was disputing. All these account numbers agree exactly to my credit report.
Again, ” proof of identity ” is the only requirement to process my credit report dispute. Experian is merely forcing me to provide ” proof of address ” for their benefit.
As a result, Experian has failed to complete their investigation within the 30-days, as required by the Fair Credit Reporting Act under Section 611 ( a ) ( 5 ). I request that Experian be fined the minimum penalty and I request that you contact Experian and mandate compliance with my credit repair request.
