IRS Tax refund ( XX/XX/XXXX ) of Maryland state tax refund ( XX/XX/XXXX ) sent to wrong bank USAA Federal Savings Bank to an account with no affiliation. IRS on XX/XX/XXXX and MD XXXX on XX/XX/XXXX have requested the tax refund to be returned to them so that my refund can process and sent to me. The USAA savings bank has not released the money after verifying it is there in someone elses account where I have no affiliation. This should have never been accepted by the bank. I spoke with XXXX in member security and XXXX bank ID # XXXX.

It’s been more then 90 days since I send out letter with no response until much later date.
I have been trying to take care of the account but can not do it online nor over the phone. So there seem to be no way to make the payment. They make it very difficult to take of this account. And it’s affecting my credit all this time.

I intend to pursue litigation in accordance with the FCRA to seek relief and recover all monetary damages that I may be entitled to under Section 616 and Section 617 if the UNVERIFIED items listed below are not deleted immediately. A copy of this letter as well as copies of the three written letters sent to you previously will also become part of a formal complaint to the Federal Trade Commission and shall be used as evidence in pending litigation provided you fail to comply with this offer of settlement. Despite three written requests, the unverified items listed below still remain on my credit report in violation of Federal Law. You are required under the FCRA to have a copy of the original creditors documentation on file to verify that this information is mine and is correct. In the results of your investigations, you stated in writing that you verified that these items are being reported correctly? Who verified these accounts? You have NOT provided me a copy of ANY original documentation ( a consumer contract with my signature on it ) as required under Section 609 ( a ) ( 1 ) ( A ) & Section 611 ( a ) ( 1 ) ( A ). Furthermore you have failed to provide the method of verification as required under Section 611 ( a ) ( 7 ). Please be advised that under Section 611 ( 5 ) ( A ) of the FCRA you are required to promptly DELETE all information which can not be verified. The law is very clear as to the Civil liability and the remedy available to me ( Section 616 & 617 ) if you fail to comply with Federal Law. Over the last three months I have submitted legal documents from USAA CREDIT CARD SERVICES TO XXXX Credit reporting agency to remove negative credit from my credit report. I have filed with XXXX 14 times showing that my credit is perfect and 14 times USAA states to XXXX that I have negative credit with USAA. I have a legal document from USAA stating to all credit companies I don’t have negative credit. I have a legal court date and have had contact with USAA attorney Ms XXXX XXXX.
( XXXX ) who has tried to fix this matter and has no Idea why USAA is not complying with a court order and legal document attached stating to all credit reporting agencies that I have perfect credit with USAA. I was on the Phone with XXXX today and they have the legal documents from USAA but when they contact USAA to confirm the document USAA denies the document.???? This has ruined my ability to get a home loan and employment due to my credit is XXXX and and it has been at XXXX for 25 years. I am a retired XXXX XXXX and live on a XXXX on the job injury. I am going to file a American Disability Act discrimination law suit against USAA if they don’t contact XXXX and clear this matter at one.

My PPP LOAN was deposited into the account on XX/XX/21 they closed on XX/XX/21 My money has been missing for quite some time now so I finally reached out to USAA and they filed a dispute to find out where the funds went. They responded today saying that {00.00} was deposited and those funds were applied to an outstanding balance and the remainder sent by check however I had no outstanding balance whatsoever and Ive never received a check for any amount from USAA. Theyre telling me to reach out to the lender which Ive done XXXX times which is why I reached out to the bank because all my lender knows is that it was funded and with this new information it in fact was funded just not to me! Im asking that they immediately return those funds!! Also my account was closed with zero warning for no reason they claimed its as because no recent deposits and claimed they sent a warning guy they never did that either I would like that investigated as well. Ive had so many issues with this bank including fraud which Ive never gotten my money back from which is why I stopped making deposits into that account in the first place. Now this! I have attached proof that my account was closed with no balance and that those funds were deposited yet Ive never received them.

Every month I deposit {00.00} into my account at usaa which the check is written to me on a usaa account. Every month they only allow me to get XXXX then place a 10 business day hold on my account which causes me to not to be able to pay rent utilities and buy medicines and groceries. My rent is due on the XXXX and I XXXX XXXX dollars for wvery day that that XXXX dollar rent isn’t paid. That’s usually XXXX XXXX dollars extra in rent i have to pay because usaa will not allow me as a veteran on a fixed income to access my funds. I’m literally going broke and without electricity or water or food or meds every month now for 5 yes. They say it can not be released however 3 months ago I got so fed up with this XXXX I called 27 times until I was transfered to a manager by the name of XXXX and he.told me.that at anytime funds can be released with a simple push of a button or two and he stated that if ever I was denied my funds to know that the location I had reached that day that wouldn’t allow it to be released is only using that method at that contact center to drive up profits by keeping the funds of depositors on hold. Today I reached a lady by the name of XXXX at extension XXXX she refused to give me the contact center address or number only her extension. She begins to tell me.her policy and.procesure of why it is right for her not not allow me to access funds I put I nto my account. I asked to speak to her manager and she just kept repeating policy. I asked her if she only gets a percentage of her pay or is she allowed to get her whole paycheck or is she gets enjoyment of causing me to be forced to pay extra on my rent resulting in no food no electricity or.meds etc..she said their policy was..

That’s when I lost it after asking for her to transfer me.to her superior and her not doing so I advised her I would be making a complaint again she wanted to talk policy..
It seems the policy is as XXXX described. To make.profit off of deposits placed in ones account by holding those funds XXXX resulting in usaas customers, Veterans and services members, being forved to go without needs being met or in higher bills resilting.also in bounced payments from insufficient funds and.cause fees to accumulate. This is wrong in every sense of the way. Please help us and stop Usaa from holding funds XXXX and let the XXXX ‘s of these contact centers know we won’t tolerate it. I asked XXXX if I could bring my children to her home for.food when we were unable to buy them.food she said to me of course not thats ur responsibility … .I hung up the phone because obviously She is bought into the idea that profit is ok even if it means hurting those that fought for her right to be a XXXX XXXX. # releasethefunds
