I cancelled my LA Fitness membership today, Aug 29. I have two fees that I believe should be refunded, but LA Fitness maintains that these fees are non-refundable.

When I signed up on May 26, 2019, LA Fitness rep didn’t explain that there’s a $49 annual fee, separate from initiation and monthly fees. LA Fitness (operational manager) says they sent a purchase confirmation indicating the annual fee, but I did not receive this email. This annual fee was charged two months after sign-up, on July 26, per their policy.

In addition, even though I cancelled on Aug 29, I have been charged on Aug 26 for September membership and for the “last month,” charged in advance when I signed up. My membership expiration date is now Oct. 26, which is much longer than when I want my membership to end, which is today.

Their policy says that membership should be cancelled 5 days before a billing date to prevent another charge. However, I was out of the country from Aug 15 to Aug 24. I decided to cancel my membership after returning from my overseas trip.

What would you like the company to do to fix the problem? (optional)
I want them to refund the annual fee (at least the amount proportional to the part of the year I will no longer be a member).

They should also refund at least one month’s fee (charged on Aug 26), if not both Sept and Oct membership charges.
