What Choice Home Warranty did:
We moved here in November of last year and I believe in December we had put in a claim for a refrigerator because the icemaker was not working they came out to fix it while we they gave us an option to have somebody else come out and fix it was it called repay we pay for it upfront and then they pay us back they denied that claim after everything happened but they ended up in the end denying the claim because there were several reasons I got several different answers every time I called because we didn’t follow every single step right correct way we never got him we claimed our garage door and edit fixed and they did not except that claim either because we did the same thing we did the call they offer you the option to pay for it and get your own technician in anyway so that’s what we did so those two claims were never ever paid by choice but the refrigerator we had somebody out here about five times and in the end we ended up having it it ended up leaking down into our basement into our mower deck but daughters bedroom ceiling God had to be fixed the bed had to be replaced and she couldn’t stay in her room she was misplaced we had to pay $1000 deductible to our homeowners they to this day have not acknowledged their part in that finally they deemed it and reporting needed replaced offered me $777 didn’t just offer it that it was take it or leave it same thing happened without washing machine except for there was no water damage no but not only did we OK the refrigerator we paid $1000 deductible to our homeowners plus we had $75 service fee x5, through Choice. So our washing machine ended up being deemed that it needed replaced and they take it or leave it again offered us 340 some dollars now we have a high end washing machine dryer and all of our plants are whirlpool they’re very nice but we just bought this house in November last year so we knew we better have a some kind of a warranty on them because the appliances are older than 10 years that was the selling point that they had was FF that’s over 10 years old we don’t even bother with it we just replace it and then my dryer they came out at least four or five times finally got it fixed but not really we just decided to stop fighting with it then our dishwasher same thing they offered us a 200 and something to replace it and that’s when I was told by one of the representatives that will ma’am that’s our cost to get it replaced not York you know that that would be our cost as we could get it for well then get the @#$%&! thing bring it to my house and replace it but we also found out that they don’t replace it based by the brand the color or anything so we can be living a life of living in the ghetto because we will have miss matched everything and I just now had to turn in my water heater and because it went out and I’m telling you this is been the worst year ever but I’m pretty sure it’s going to end up having to be replaced to but still make sure that we have to pay several times for them come to come out and look at it so cold fix it but we will not even do that we will just if it if it because if they can’t fix it the first time then we’re done think that’s what our Experience has been so far

We just want appliances that are equal value to what we have and have the same options as close as you can match it to what we already have in his house like we were told what happened we have three so far that were deemed replaced after working on them several times and they often offered us such ridiculous amounts of money they didn’t offer him yet they said take it or leave it and it doesn’t even begin to cover the expenses we have to we will have to replace these appliances we just want our appliances replaced and them do the work not us

What Choice Home Warranty did:
The compressor on my 25 year old heat pump failed in May 2021. It has taken Choice Home warranty 6 months and 2 seperate technicians to get the diagnostics they require to move on this claim. During this time I have had no A/C in my house (the compressor died just 1 week prior to the heat wave that occured in May). Now the weather has cooled way down and I am stuck using my “emergency” heater from the interior unit that is also old, beyond its life expectancy and might also die at any time.

Choice has now stated:

“During the coverage period, our sole responsibility will be to arrange for a qualified service contractor to repair or replace, at our expense, the systems and components mentioned as “Included” in accordance with the terms and conditions of your contract so long as such systems and components:

Are located inside the confines of the main foundation of the home or attached or detached garage (with the exception of the exterior pool/spa, well pump, septic tank pumping and air conditioner);and
Become inoperative due to normal wear and tear; and
Are in place and in proper working order on the effective date of this home warranty contract. This Contract provides coverage for unknown/undetectable pre-existing conditions so long as the malfunction could not, or would not, have been detected by a visual inspection or simple mechanical test.

Your claim was submitted on 05/10/21 and was assigned to Universal Comfort Heating & Cooling on 10/18/21. After the appointment date on 10/26/21 the technician submitted details pertaining to your system failure.

It has been determined that the condenser fins on the HVAC system are physically damaged and folded/flattened. Airflow is restricted which will result in over heating and over working of the system. The compressor has failed as a result. This does not constitute a normal wear failure.”

The home inspection that I paid for (July 2020) prior to the home warranty being purchased (August 2020) stated:

“Major Defect, Comment – The estimated useful life for most forced air furnaces is 15-20 years. This furnace appeared to be beyond this age and/or its
useful lifespan and may need replacing or significant repairs at any time. Recommend budgeting for a replacement in the near future.
Major Defect, Comment – The estimated useful life for most heat pumps and air conditioning condensing units is 10-15 years. This unit appeared to be
beyond this age and/or its useful lifespan and may need replacing or significant repairs at any time. Recommend budgeting for a replacement in the near
future.
No identifying information could be found on the unit however, the general appearance and condition suggest that it is old.”

The 2 technicians that were contracted by Choice have both stated that the unit has exceeded it’s life expectancy, nothing else remarkable to report. Since then I have called out 2 technicians from other companies that concur, the unit is beyond it’s life expectancy there is no damage beyond normal wear and tear. I have pictures from the inspection showing the unit in the exact same condition as it is today, old and worn.

I would like some assistance to get Choice Home warranty to pay for the replacement of this heat pump as their warranty promises.

Other history that might help with this issue:
1) The interior fan died in the fall of 2020 and was finally repaired in the spring/summer of 2021. It took 2 different technicians from Choice to get the fan repaired. All winter of 2020, we had to use space heaters which doubled our electric bills.
2) The interior fan was finally repaired in the spring/summer of 2021 by the Choice Warranty technician (JAS Heating). Several weeks later the contacts on the outside unit started making buzzing noises so we had to turn off power to the outside heat pump unit.
3) The contacts on the outside unit (heat pump) were repaired in the summer of 2021 by the Choice Warranty technician (JAS Heating) and 2 weeks later the compressor died. This was 2 weeks prior to the heat wave we experienced in May of 2021.
4) The Choice Warranty technician (JAS Heating) came back out in May 2021 and sent diagnostics on the failed compressor to Choice Home warranty.
5) Choice Home warranty said they needed more diagnostics but could no longer get information from JAS Heating so they had to reassign the claim.
6) In October of 2021 they finally assigned the claim to Universal Comfort Heating & Cooling on 10/18/21.

It will cost me over $10,000 to replace the heat pump. I have begun the process of getting estimates on replacing the system. Additionally due to their negligence of acquiring technicians in a timely manner I have paid double on my electricity bills.
