What Santander Consumer USA did:
my loan was originated January 1, 2020, which was after the effective date for entitlement to restitution and inclusion in the settlement but was two months before the settlement was announced. even though the effective period was defined as May 1, 2020 and prior. None of the new loan practices including budget calculation, expenses or proof of income were enacted and they required I get a extended service warranty which was forbidden in the settlement. They were also required to re-examine all loans that fell into default after with the new practices in place, yet when I fell into default they were not. given that my loan originated a few days before quarantine started immediately found a default in my car was eventually repossessed in February 2022 for the first time and the second time was the beginning of this month.
