Want to Sue Cunard Cruise Lines?

How to Sue Cunard Cruise Lines

Looking to sue Cunard Cruise Lines? Small claims court is an option, and you may have others…

Cunard Cruise Lines, despite their friendly exterior, sometimes treat their customers poorly. But they make it hard to pursue justice since you can’t sue them outright. If you have a grievance against Cunard and want justice, you may have no choice but to take them to small claims court.

1

Determine Whether Your Claim Qualifies for Small Claims Court

Firstly, you’ll need to figure out whether your claim against Cunard qualifies for small claims court. There are two things you need to consider:

  • Most small claims courts only allow you to press a claim for a monetary award. Other courts will allow you to pursue an equitable award, which deals with any nonmonetary arrangements
  • Additionally, most small claims courts only allow claims up to about $10,000 (with a lower minimum of around $2500)

If your claim against Cunard fulfills both of these criteria, you should be fine. Double-check your state requirements, as the specific limits or allowances for small claims courts can vary from place to place.

If your claim doesn’t qualify for small claims court, you may still be able to pursue arbitration against Cunard using the organization most cruise lines rely on for settling disputes: the National Arbitration and Mediation company.

2

Write Out Your Demands in a Letter.

If small claims court is the way to go, the first thing you need to do is write out your demands against Cunard in a letter. These demands should be explicit but can be relatively simple; it’s giving Cunard a chance to handle your problem before you take them to court and it’s a good thing to have for your records.

Keep your statements short, sweet, and to the point. You need to mail Cunard a hard copy of your demand letter using this address:

Cunard Line
24305 Town Center Dr, Suite 200
Valencia, CA 91355

Don’t forget to keep a copy of your demand letter for your own records.

3

Fill Out Your Court Forms.

Now it’s time to fill your court forms. Your court’s local website should have all the forms you need for your filing process. Again, the exact forms necessary will vary from state to state. But you’ll likely need at least three or four copies of everything for the full filing process and so you can keep a copy for your records.

4

File Your Forms.

Then you’ll need to file the forms with your local courthouse. Chances are high that you’ll to head there in person within certain business hours or on certain days of the week, so double check your court’s website. Additionally, you may be able to get the fee that most courthouses charge waived if you don’t have much of an income. A few courthouses may allow you to electronically file the forms, though these are rare.

5

“Serve” Your Forms on the Cruise Lines.

You’ll also need to actually serve the forms to Cunard; this lets them know that they are being sued in the first place. The process for doing this is detailed on your court’s website. But be sure to do everything perfectly, as the court might throw away your claim if you make a small misstep (like forgetting a form in the package you send to Cunard).

6

Attend Your Court Date.

When all is said and done, all that’s left is for you to attend your court date at the correct place and time. Be sure to have these memorized and put together a package of all your documentation and required forms beforehand. Show up on schedule and represent yourself to the best of your ability – even better, many big companies like Cunard don’t always bother with small claims court issues, so you might be the only one there, virtually guaranteeing a victory.
