Before you can run off and sue Equinox in small claims court you need to make sure your case qualifies. Small claims court is a specific type of court that only handles certain issues.
If your claim doesn’t fall within the limits of your state’s small claims court, you’ll have to arbitrate your claim instead.

Does your case qualify? Great now you have to start the process of a lot of paperwork and a lot of postage. The first thing you need to do is send a demand letter. Small claims courts require that you formally ask the company to fix the problem before you sue Equinox in small claims court.
This can be a very simple letter, just a few sentences explaining the situation, giving them your contact information, and explaining what you want them to do to fix it. Remember you just have to check a box.

The hope is that they will get your demand letter and respond to it appropriately but if they don’t, you move on to filling out the right court forms to officially sue Equinox in small claims court.
Now comes the official legal forms.

Every state is different in terms of the forms they require. Depending on where you live you might have additional forms tacked onto your requirement from your county. Check your state court website to find the right forms and be sure to print off and fill out enough copies.
When you move on to the next step you will be very grateful that you brought the right number of copies which in most cases is three or four.

If you are particularly lucky your area will have more lenient rules that allow you to file your documents through the mail.
You have to pay a small claims court filing fee which can be listed on your court website after which the clerk will take your copies, stamp them, keep one for the court, and give you back yours. They will also give you your hearing date.
After everything is filed with the court to you now have to notify the company that they are being sued officially.
This step is called serving. Part of the reason you need so many copies of your documents is because some of those copies go to the company when you serve them.
You have to be particularly careful to follow every rule about how to serve a defendant based on where you live. If you miss a single rule, your case can be thrown out.
Look at your court’s website for instructions on how to properly deliver your forms to Equinox, or search for “[your state] small claims service of process”.

Bring your copy of the filed court documents and any evidence you have to back up why you decided to sue Equinox in small claims court.
The judge will render a decision, possibly on the same day but it could take several weeks depending on the circumstances involved in your case.
