Dish Network Corp. can’t force an insurance company to pay for its defense in copyright litigation it ultimately settled with four television networks, the Second Circuit affirmed.
An exception in Dish’s policy with ACE American Insurance Co.’s policy excludes entities in the “broadcasting” business from advertising injury coverage, the U.S. Court of Appeals for the Second Circuit said in its opinion filed Wednesday. Dish argued a lower court erroneously applied a plain-meaning definition of “broadcasting” to the exception, which it says shouldn’t have applied, leaving ACE obliged to cover its litigation costs.
