Uber Technologies Inc. will avoid facing a proposed class of consumers challenging the claimed flat delivery fee on Postmates, after a judge in San Francisco ordered the case into arbitration Thursday.
Postmates customer Akia Hicks sued the delivery platform in San Francisco Superior Court, alleging it misleads consumers into believing it provides a low-cost delivery service by charging a flat fee, while simultaneously recouping delivery fees by marking up the cost of food above what is charged by the restaurant.
