Looking to sue Celebrity Cruise Lines? Small claims court is an option, and you may have others…
Celebrity aims to make their passengers feel like their namesake… or so they say. Sometimes, their passengers have legitimate grievances, whether it’s about their customer service or about pricing. Whatever the case, if you have an issue with Celebrity Cruise Lines, it might be time to take them to small claims court.
Firstly, you should figure out whether your claim qualifies for small claims court before starting the entire process. Small claims courts usually only handle specific types of cases:
For instance, if your case is valued at $20,000, you’ll probably need to pursue a different line of resolution against Celebrity. Thankfully, you can do this using the National Arbitration and Mediation company, which handles disputes against big cruise lines like Celebrity all the time.
But if your case is less than $10,000 and more than $2000-$2500 or so, you’re good. Double-check with your state requirements, as the actual values can vary a bit.
Provided your claim qualifies, your next step is to write a demand letter to Celebrity explicitly spelling out what you want them to do and how they can solve your issue. It doesn’t matter necessarily whether they agree to your demands (although that would be nice). The point is that you do this to cover a legal requirement so you can proceed with small claims court filing.
Your demand letter doesn’t have to be that complex. Keep your statements short and to the point and, once it’s all done, send the letter to Celebrity’s mailing address at:
Celebrity Cruises
1050 Caribbean Way
Miami, FL 33132
We’d also recommend keeping a copy of your demand letter for your records, just in case Celebrity tries to claim that you never sent one.
If and when Celebrity doesn’t respond to your letter, you can go ahead to your local small claims court and begin filling out the required forms. These forms will usually be required in triplicate or in even greater copy quantities for filing purposes and so you can keep some for your records. Your small claims court website should have all the details, including how many copies you need to complete.
Next, you can file your completed forms at the same courthouse, although they will likely require you to drop them off in person instead of filing them online (there are a few exceptions here and there). You’ll also need to pay a small fee; this can be waived if you can prove you have a low income at the time of filing.
Most importantly, you’ll need to serve the forms to Celebrity. This tells the cruise company that you are serious about pursuing resolution and will sue them to get results. However, don’t do this sloppily. Double-check that all the forms are filled out perfectly and you file the perfect forms to Celebrity as recommended on your small claims court website. Doing this incorrectly could result in your claim being thrown out by the court!
Once everything is done properly, all you need to do is wait for your court date to arrive and show up to represent your interests. We’d recommend getting all your documentation together beforehand, so you aren’t scrambling the day of the case. Represent yourself as best you can, and you’ll stand a great chance of getting the resolution you deserve.
