When StubHub customer service fails

How to Make the StubHub Corporate Office Listen

A legal option that can get StubHub to listen — and get you compensated.

When customer service fails, you have other options to fight back.Trying to get a company as large as StubHub to listen to your complaint can leave you feeling like David fighting Goliath.

This is particularly true when StubHub made a mistake that cost you money. It can be next to impossible to get in contact with someone who isn’t a robot to resolve your issue. Often, when StubHub makes a mistake it ends up costing you time and money.

Phone calls have long wait times and people who don’t have the power to fix anything on the other end. Emails end up in a black hole with boilerplate responses. Requests to speak with someone who has authority are ignored. You’re passed around customer service to no end.

Maybe they tell you the problem will be fixed, but as you check your email or look at your account, it remains very much not fixed. So you are forced to follow up and start the process all over again.

So what can you do other than feel like someone who is completely taken advantage of?

Use Arbitration to Settle Your Dispute with StubHub

Doing business with big, faceless companies can leave you feeling powerless. You are just one of thousands of customers who might be calling StubHub with an issue.

Your user agreement with StubHub likely includes what is called an arbitration clause. This prevents you from suing StubHub in most courts or joining a class action lawsuit — even if you aren’t alone in your complaint.

However, arbitration is often a great way to escalate your complaint with StubHub.

Arbitration is a way to get a satisfactory solution to your problem with StubHub without suing them. Arbitration makes StubHub work with a neutral third party to whom they are legally bound to listen and resolve your issue fairly. This third party is an arbitrator who is familiar with the type of case involved, is impartial (doesn’t work for StubHub), and will make a legally binding decision in the end.

Arbitration is Fair, Just, Reasonable, and Transparent

Arbitrations handled by the American Arbitration Association® is an option which complies with the Statement of Principles of the Consumer Due Process Protocol, which means:

  • The process must be fundamentally fair for everyone, including you. That also means everyone should have a fair appointment of an impartial, competent, and qualified arbitrator who conducts fair hearings.
  • A reasonable standard is applied to the process. This just means you all get access to all of the pertinent information, they have to schedule a good time for the hearing, pick a good location, and provide it at an affordable cost.
  • The transparency standard means the arbitration agreements have to be clear, easy to understand, and include all the necessary information and provide you and the other party with the ability to hire representation.
  • An alternative to arbitration, which takes the form of small claims court and, in some cases, mediation, has to be available to you, if you choose.
  • The process should be just, fair, and allow the arbitrator to award you the same outcome you might receive in the courtroom, an award which is a legally binding decision.

Arbitration Gives You Leverage Against StubHub

Upon notifying StubHub that you are going to pursue arbitration, they know they are going to be required to pay expenses out of pocket. They may also lose the claim and have to give you what you are asking for on top of the expenses they pay for the arbitration process. Once StubHub knows they are going to incur an expense, they become more willing to meet your demands.

There are cases where StubHub may continue to ignore or refuse to offer a settlement in which case, you still have reasonable, transparent, and fair hearing options without having to spend any money. Our FairShake process will help you file for arbitration. It won’t cost you anything unless you win.

Leverage Leads to Faster Settlements with StubHub

With this, you remove the power StubHub had over you. By initiating the arbitration process, you take control of the situation. Now you are on equal footing with a neutral arbitrator who will fairly examine both sides of the issue.

The first step in using this leverage to solve your issue is to formally raise your complaint with StubHub.

At FairShake we help you do this. We send a demand letter to the StubHub corporate office to start the process of solving your case before you move forward with arbitration. We give them a time frame to offer you a resolution, usually 30 days (though your contract with them might specify something else).

At this point, approximately half of cases settle because StubHub makes an acceptable offer.

But what if they don’t?

Your next step is filing your case with the American Arbitration Association. FairShake will put together all the official arbitration paperwork for you and guide you through the next steps.

Do I need an attorney?

If you end up going forward with arbitration, you have the right to bring an attorney or go at it alone.

There are some situations where an attorney is better and some where you might decide you don’t need one. For example: there are many common common complaints that people have against this company which fall under very specific laws. If yours falls under a specific law, it’s easier for you to obtain higher levels of compensation on your own. In legal terms, if you don’t have an attorney with you that means you are bringing your claim “pro se”. If you decide that you want to go forward without an attorney, check out some information from The American Arbitration Association’s Pro Se Case Administration Team.

However, if your situation involves something more convoluted, maybe multiple problems, or a violation of federal law like illegal robocalls, then it might be in your best interest to have an attorney there to help you maximize the potential value of your claim.

What can I do next?
