Your Nu Skin Contract probably says you can’t sue Nu Skin in any court except Small Claims Court, thanks to an arbitration clause. It can be complicated and time consuming, but if you sue Nu Skin in small claims court and follow each rule, it usually gets you what you want.
Start by making sure your claim qualifies. Small claims courts are for specific types of cases just like any other court. Before you can sue Nu Skin you need to check two things:
If your claim doesn’t fall within the limits of your state’s small claims court, you’ll have to arbitrate your claim instead.
Before you sue Nu Skin in small claims court you have to write and send what is called the demand letter. Most small claims courts require that you ask the person you’re suing (the “defendant”) to fix your problem voluntarily before you file your claim.
Your demand letter can be simple and straightforward – tell Nu Skin who you are (your name, address, phone number and account number), what the problem is, and what you want from them. It doesn’t have to be longer than a few sentences, so long as you do it. If the courts find out you skipped this step, it can ruin your attempts at compensation.
When you’re done writing, you need to mail a hard copy of the letter, preferably as certified mail or some other service that allows you to confirm delivery, to their legal address:

If they don’t respond to your demand letter then you move on. In order to sue Nu Skin in small claims court, you’re going to need to fill out some paper work.
There are different forms to fill out based on where you live. Every state has a different set of forms which you will likely have to fill out in triplicate (you’ll see why in the next steps) and sometimes your county might have additional forms. Find your state court website here.
The next step when you sue Nu Skin in small claims court is to officially file those documents with the court. This is where you get your chance to march up those Courthouse steps and hand the documents over to the court clerk.
You need three or four copies in most cases because the court gets one, you get another, and the final copy is saved for the defendant Nu Skin in this case. You will have to pay a small claims court filing fee after which you will get back the stamps copies and your assigned hearing date.
You are nearly halfway there. Now you have to notify the company that they are being sued. This is a process called a serving and this is where you take one of those stamped copies from the court and send it Nu Skin in accordance with the rules for serving a defendant as laid out on your state court website here.
If you can’t find the rules you can also search for “[your state] small claims service of process”. make sure you follow each and every rule because even a single mistake can cost you your ability to Nu Skin.
Now you have reached the final step. Make sure you go to the right courthouse, on time and have your copy of the filed court forms and any other evidence to back up your side of the story.
Nu Skin may or may not send someone to oppose you but either way your job is to explain to the judge why you decided to Nu Skin in small claims court and why you deserve compensation.
